Defective Products in the Great Southwest.

A mis-labeled product is not confined to our area, obviously.  Americans encounter improperly labeled products on a daily basis.  The manufacturer may “think” that the bottle you are using contains the exact information.  Unfortunately, this is not always the case!  Mistakes are made even with careful scrutiny.

Have you ever heard of the McDonald’s Hot Coffee Case?  Who hasn’t?  In that case, an elderly woman spilled scalding hot coffee on her lap that was not labeled as being potentially dangerous.  Because of this inadequate warning she suffered mightily and spent time in the hospital from her serious burns.

Ken Wagner was an integral part of winning that case for Stella Liebeck.  Today, two plus decades later, he leads a team that vigorously defends people of Albuquerque and the Great Southwest when they have been harmed by a manufacturer’s mistake.  If this applies to you or a loved one call the office of Ken Wagner Law at (505) 232-6300.

I’ve Been Hurtin’ on the Railroad.

No mistake here, the headline refers to the hazards of railroad accidents in America.  It is still a very real situation.  In The Great Southwest trains are traveling at high speeds every day.  Did you know that in 2016 there were more railroad injuries than any year in the last decade?  You would think that it is getting safer, but it’s not!

Why is this?  Well, train usage continues to increase in New Mexico and the surrounding states.  Here are some of the main reasons for train accidents –

1.  The structure and maintenance of the tracks
2.  The equipment of the railroad company and its age
3.  A faulty signal
4.  Of course, human error

Railroad accidents whether fatal or not should be represented by a personal injury attorney.  One of the very best railroad accident lawyers in the Great Southwest is Albuquerque’s own Ken Wagner.  Ken and his staff will get to the root of the matter and prosecute your case aggressively.  Call the office of Ken Wagner today at (505) 232-6300.

Feel the Summer Burn.

Did you know that over a million Americans a year suffer some sort of burn injury?  Summertime is a particularly susceptible time for painful and often disfiguring burns.  Commonly, a burn injury of severity may be caused by an auto accident.  Carelessness around boiling water is another.  There are also electrical and industrial accidents.

Burn injuries have three classifications –

1.  In a first degree burn only the outer layer of your skin is affected.
2.  In the second degree type blisters containing fluid and much more pain are involved.
3.  Third degree burns are the ones we hear most about.  They may require hospitalization and a long period of rehabilitation.

In the case of third degree burns someone may need to be compensated for loss of income and huge medical bills.  To try a personal injury case involving negligence causing severe burns you need a specialist.  In the Great Southwest that firm is Ken Wagner Law.  They are Albuquerque’s burn injury attorney law firm.  Call them right away at (505) 242-6300.

Defective Products are Everywhere.

There is one mantra to live by…if you did not make it yourself, then it could be defective.  Since that applies to nearly everything, there are defective products all around us.  It could happen for a number of reasons including a design flaw, or an improper warning label.  Dangerous products kill thousands of people every year in this country.

A defective product could include, but is certainly not limited to  -

1.  The tires on your vehicle
2.  The very vehicle that you are driving
3.  Toys that your kids play with
4.  Medications that you and your family take every day…and on and on it goes.

If you or a loved one has been victimized by a defective product in the Great Southwest you cannot do any better than contacting the man who won The McDonald’s Hot Coffee Case!  That man and his firm are right there in Albuquerque defending our area against the experience of a defective product.  Call the ABQ office today at (505) 242-6300.

Construction accidents may include, but are certainly not limited to-

1.  Objects falling from above.
2.  People falling from above.
3.  Exposure to noxious gas.

5.  Carbon monoxide exposure.

An accident of this magnitude, while rare needs to be handled immediately.  That is why people near Albuquerque have known for decades to call the office of Ken Wagner.  He is the Great Southwest’s construction accident attorney.  Do not hesitate.  Call Ken and his staff right away at (505) 242-6300.  Meanwhile, visit the construction accident page of www.kenwagnerlaw.com.

I Hear the Train a Comin’

With fond memories of Johnny Cash, we wanted you to remember that in a confrontation between a train and whatever you are driving…you lose!  There are about ten thousand train accidents per year in the United States.  Train usage actually continues to grow in the Great Southwest.

There are four main causes of train accidents –

1. A mistake by a human
2. The structure and maintenance of the tracks themselves
3. The very equipment that is on the train
4. The proper or improper functioning of the signals

Train accidents are fairly rare, thank heaven, but when they occur they are usually catastrophic.  If you need aggressive defense against a major hauler with deep pockets you need to hire Ken Wagner and his firm.  With a half-century of experience, The Great Southwest’s train accident attorney wants to hear about your case.  Call the Albuquerque office today at (505) 242-6300.

Deadly Drugs at Nursing Facilities.

I’ll bet that you did not associate a nursing home with the use of “deadly drugs”.  Sure, there are many prescription medications at these facilities, but “deadly”?  In a recently reported case a vigorous 78 year old man was diagnosed with dementia.  Without the family’s consent, he was given drugs that were known to be fatal in older patients.

Once this story came to light people from all over America came out of the woodwork telling stories of their loved ones being given psychotropic drugs without consent.  Wrongful death suits have begun cropping up nationwide against nursing facilities who would administer such drugs without the knowledge of the immediate family.

If any of this sounds familiar you must take action to protect your loved one.  In the Great Southwest the man and the law firm to contact is Ken Wagner Law.  Attorney Wagner is Albuquerque’s nursing home drug misuse lawyer.  He and his team will begin an immediate investigation into your case.  Just call (505) 242-6300.

Truckin’ into the Summer of ’17.

The Grateful Dead just celebrated their 50th anniversary and America has been truckin’ for over a century.  Truck safety has certainly improved over the decades, but on the freeways of the Great Southwest there are still some trucking accidents that need aggressive representation for those on the wrong end.

The Federal Motor Carrier Safety Administration (FMCSA) keeps track of such things.  In the most recent complete reporting year of 2014 nearly 4000 large trucks were involved in fatal accidents.  In a one-year period leading up to that, the number of large trucks involved in injury accidents rose by over 20%.  It seems to be getting worse!

So, what is going on here?  The truth is, we live in an area where big trucks drive fast and not always safely.  If you or a loved one was injured in an accident involving a truck of over 10,000 pounds you know who to call - The office of Ken Wagner Law in Albuquerque, New Mexico.  Ken and his staff is the Great Southwest’s truck accident law firm (505) 242-6300.

Is it Safe?

No, this is not a line from a movie uttered by Laurence Oliver to Dustin Hoffman.  This is all about the products that America uses every day.  The very items that we trust to be safely manufactured and distribute for daily use may be the ones that kill or injure you or a loved one.  It happens every day in this country.

Cars, the tires that move them, the medicines that you take, the medical devices that you use, the toys that your kids play with, the restaurant food that you consume.  These things and much more are products that you trust when you use or consume them.  If something goes horribly wrong because of a manufacturer’s neglect action must be taken.

If you could choose anyone in the country to represent you do you think it might be the attorney who lead the fight in winning the McDonald’s Hot Coffee Case?  There is no more famous product neglect case than this one.  Give me Ken Wagner and his team every time!  If you are anywhere in the Great Southwest call the Albuquerque office right away at (505) 242-6300.

Increase in Motor Vehicle Fatalities.

We will one day live in a country where nearly every vehicle is operated by a non-human.  When that occurs motor vehicle fatalities will become a thing of the past.  Meanwhile, the situation demands attention.  In the most recent reporting year of 2015 fatalities from motor vehicle crashes were up over 7% with 2348 more people dying on the nation’s roads.

As a matter of fact, the rates for passenger car and light truck deaths were the highest in the US since 2009.  SUV fatalities were up more than 10%.  Van fatalities increased nearly as much.  Motorcycle fatalities were the highest since 2012.  Perhaps the most disturbing statistic was another increase in alcohol-related accidents.

The day will come when it won’t be necessary to think about these things…sort of like smallpox.  That day is assuredly not here yet.  In the Great Southwest the firm you can trust to handle your vehicle accident injury case is Ken Wagner Law.  Ken and his staff will represent you aggressively from his Albuquerque office.  Please call them at (505) 242-6300.

Ride on Hog…Ride On.

Ahhh Springtime!  It’s time to get that motorcycle out and ride the breathtaking roads of the Great Southwest.  They can be treacherous roads as well.  What do you think kills more millennials and kids between kindergarten and their mid-thirties?  Believe it or not, it is accidents related to motorcycles!

The threat is even more real on our open roads as opposed to congested large northeast cities.  This may not bring you much comfort, but in the majority of the cases the fault is NOT with the motorcyclist, but rather the driver of the other much bigger vehicle.  Defective equipment and heavy spring rains can also lead to a tragic mishap.

We hope that neither you nor a loved one are involved in a serious or even fatal accident.  If you need strong, steady, experienced representation please call Albuquerque motorcycle accident attorney Ken Wagner.  His half-century of personal injury experience and an amazing staff are behind every case.  Anywhere in the Great Southwest call Ken Wagner Law at (505) 242-6300.

Sloppy Medical Practices.

We have all heard about the really dumb stuff.  A surgeon operates on the wrong leg or leaves a something in the patient’s body.  These days, thank goodness, those incidents are becoming more rare.  Blunders still occur though.  For example, a surgeon may be operating on the wrong vertebra because of an unclear X-ray.

The bigger issue may be whether or not the treatment plan is even right in the first place.  There was actually a U.S. study that revealed nearly HALF of the patients surveyed did not receive the recommended care for their particular conditions!  Humans are not cranked out of some assembly line and one treatment does not necessarily fit all.

All of this is simply to say that you or a loved one may have been given shoddy medical treatment.  If that is the case, then you may have a case against a physician or medical center.  If you have received improper medical care in the Great Southwest please call (505) 242-6300.  The office of Ken Wagner headquartered in Albuquerque may be able to get you the compensation that you deserve!

What to do as a Victim of a Hit-and-Run.

A hit-and-run accident is probably more common than you think.  In this day and age with camera phones and other surveillance you would think that those days may be behind us.  A surprising 15%+ of all pedestrian car accidents are hit-and-runs.

After you experience the panic and anger as a victim you need to take carefully measured steps.

1.  Immediately call for help.
2.  Try to identify the other driver in any way possible.
3.  Look around for witnesses.
4.  Call your insurance company.
5.  Call an attorney!

All of these steps are important in coming out of this experience whole.  When you deal with this type of accident you would do well to remember the name of Ken Wagner.  Ken Wagner Law has been helping victims get their proper compensation in the Great Southwest for 40+ years.  Call on the services of Albuquerque hit-and-run accident attorney Ken Wagner at (505) 242-6300.

Nursing Home Abuse in the Great Southwest.

It is a painful subject.  Nursing home abuse is an epidemic in this country.  Make no mistake about it, the vast majority of individuals and facilities are first rate and treat their patients like family.  However, the sad truth is about 10% of all residents of nursing homes are mistreated in one way or another.

The first issue is facing the truth.  You are not there to see the up-to-the-minute care that the person who helped raise you to adulthood is getting.  Even speaking with them may not give you a clear picture.  Sometimes you must rely on visual evidence.  The next time that you visit look for scrapes or cuts or any other malformities and start asking questions.

If the answers you receive from both the patient and the staff do not mesh, then it is imperative that you take steps to correct the problem.  Your first action may be to call the office of Ken Wagner.  Ken and his staff have protected nursing home patients in the Great Southwest for decades.  Please don’t wait another day.  Give the Albuquerque office a call at (505) 242-6300.

Accident Liability with Uber and Lyft.

Just a few years ago we did not even know what those terms meant.  Now they are billion dollar business in the United States.  With auto accidents involving Uber and Lyft increasing as quickly as these businesses are growing you need to become aware of their liability.  Many of you reading this will hire one of these rideshares in 2017.  We hope that every trip is a safe one.

Maybe the most important thing to know at this point is that drivers of Uber and Lyft are not employees like taxi drivers.  Of course, both companies do background checks and don’t just let anyone drive for them.  Both Uber and Lyft offer one million dollars of liability insurance, but there are limitations as to whom it covers.

This new gray area is definitely something that you need to be aware of.  If you or a loved one is involved in an Uber or Lyft car accident do not take anything for granted!  You must treat this with your full attention moving forward.  Contact Great Southwest car accident attorney Ken Wagner at his Albuquerque office to discover the next step at (505) 242-6300.

Inside the McDonald’s Hot Coffee Case.

Here is a clip from Adam Ruins Everything.  If you ever had a pre-conceived notion about the historic McDonald’s Hot Coffee Case this could change your perspective forever.

Back in the 1990’s the victim Stella Liebeck was widely criticized and parodied on late night television about her supposedly “frivolous” law suit.  We were bombarded with speculation and half-truths about the incident.  In the long run (a quarter century later) people still have strong opinions not only about the case, but its implications on the judicial system.

After you have viewed this three minute video clip you will probably have more knowledge about the case than you have ever had.  The bottom line is this…Ken Wagner of the Wagner Law Firm located in Albuquerque NM was one of the attorneys who won Mrs. Liebeck’s case.  Now that you know more of the facts it is very comforting to know that this courageous attorney still serves the Great Southwest.  If you have a possible personal injury claim call his office at (505) 242-6300.

Slow Down…It’s Holiday Time.

Come on, relax.  It’s time to slow down and enjoy the season.  Are you pointing your car north toward Colorado or Utah?  Be prepared for winter driving.  How about Texas?  The weather could be nicer, but changing rapidly.  Maybe you are headed west to Las Vegas…lucky you!  Wherever you are traveling in the Great Southwest slow down and enjoy the ride.

Holiday roads can be tricky with sudden snow storms and black ice.  Statistics from The National Safety Council show that Christmas and New Years are two of the ten most dangerous driving days in the United States every year.  They are both coming up, so be forever vigilant of the guy driving next to you or in front or behind you.

As we approach 2017 one thing is as true as it was 40 years ago and even longer.  The lead attorney who has protected residents of Albuquerque and the Great Southwest in personal injury claims is stronger than ever.  He is Ken Wagner.  Ken and his staff wish you a wonderful holiday season, and if you happen to need us in the New Year, call (505) 242-6300.

Some Holiday Toys That Could Hurt Your Kids.

No one wants to take the joy out of the holiday season, but it pays to be cautious when buying Christmas presents that may be hazardous to your children.  Did you know, for example, that McDonalds issued a toy in its Happy Meal a couple of years ago that had to be recalled?  It was called the “Hello Kitty Whistle”.  Two kids choked on parts of it that came loose before it was recalled!

The Ace Bayou Bean Bag Chair claimed the life of a 10 year old boy in Texas and a 3 year old girl in Kentucky when they suffocated within it.  Have you ever heard of the Cannondale Tandem Bicycle?  A problem with the fork of this particular bicycle has caused riders to lose control.  Consumer Reports tells us that 5000 Americans a year die in bicycle accidents.

Just be vigilant this holiday season.  Give gifts that are age appropriate.  When you do, monitor the use of those toys and games by your children.  If you ever discover a defective product, contact Attorney Kenneth Wagner.  The winner of the McDonalds Hot Coffee Case has been protecting people in the Great Southwest from defective products for decades from his Albuquerque office at (505) 242-6300.

The McDonald’s Hot Coffee Case.

Even though it has been two decades the McDonald’s Hot Coffee case lives on in history.  If you mention it even today it conjures up all sorts of different opinions.  If you are not familiar with it, it was the product liability case of Stella Liebeck vs. McDonalds, the fast food giant.  This occurred after she spilled hot coffee in her lap.

Interestingly, Esquire Magazine has just picked up the mantle and written a fascinating article on the nearly 25-year old case.  Please check out the September addition of Esquire.  In it you will find a well-crafted retrospective entitled, “What you don’t know about the McDonald’s Hot Coffee burn case”.  If you have the opportunity, give it a careful reading.

Some quarter century later the man who successfully represented Mrs. Liebeck is still practicing in Albuquerque, New Mexico where the incident occurred.  His name is Kenneth Wagner.  Attorney Wagner and his staff are important people to have on your side if you have a personal injury case in the Great Southwest.  Call the office at (505) 242-6300.

What to do after a Car Accident.

It is the most common personal injury lawsuit.  Do not think that because you and your loved ones were able to walk away from a car crash that everything is fine.  There are over 2 million vehicle accidents per year in the US that result in an injury to one or more people.  The most important thing to do in this confusing, stressful situation is NOT to drive away from the scene.

You need to contact the police immediately.  While you await their arrival set up flares around the scene to avoid further collisions.  In today’s world there is little or no excuse for not taking pictures with your phone of all aspects of the crash.  Get all of the other driver’s information such as license, insurance, and phone number.

Too many Americans take a laissez-faire attitude and find out later when pain and obvious injuries begin to manifest themselves that they should have been more proactive.  Getting into a car accident is no sin.  What you do afterwards may affect the rest of your life.  Call Ken Wagner as soon as you can.  Attorney Wagner and his staff are the auto accident personal injury attorneys you seek in Albuquerque and the Great Southwest.  Know this phone number - (505) 242-6300.
