We have all heard the term, but what does wrongful death
mean exactly? Here is a dictionary
definition of the two-word phrase. It is
a “civil action in which damages are sought against a party for causing a
death, typically when criminal action has failed”. It is a claim against a person who can be
held liable for a death.
Usually a wrongful death suit is brought by relatives of the
deceased. Any fatality caused by the
wrongful acts of another might result in a wrongful death claim. Many of these
claims are based upon death resulting from negligence, for example following a
motor vehicle accident caused by another driver, a dangerous roadway or
defective vehicle, or even medical malpractice.
This is a very serious issue which must be treated with
thoughtful consideration and planning.
