The History of Personal Injury Law.

We know that its roots go back thousands of years.  Even going back to Biblical and ancient times, the roots of what are now known as tort law and personal injury law were established.  The law of retribution meant someone who harmed another was required to repay the person harmed.  It was in its simplest form in those days.

Fast forward to the late 18th and early 19th century.  The first factories were built and populations grew.  To put it mildly, the Industrial Revolution changed the way people lived their lives.  Workers were injured or even killed on the job because the legal system had not yet caught up and there were relatively few remedies available for injured workers.

Today, attorneys are seeing strong personal injury claims all over America.  New Mexico and The Great Southwest are certainly no exceptions.  We at Ken Wagner Law are always a phone call away when you feel that you have a personal injury case.  From our patriarch Ken Wagner and his caring staff to all of you, Merry Christmas and a very Happy New Year.

Liebeck vs. McDonald’s Restaurants.

You may know it as the McDonald’s Hot Coffee Case, but chances are you DO know of it.  This was a landmark case in American history.  It was a 1994 product liability lawsuit in which a civil jury awarded 2.86 million dollars to plaintiff Stella Liebeck.  She suffered third-degree burns to her pelvic region when she spilled hot McDonald’s coffee in her lap.

Legal scholar Jonathan Turley (look him up) has declared the claim a “meaningful and worthy lawsuit”.  We don’t wish to take this small space to sum up the case, but suffice to say Mrs. Liebeck was in no way greedy.  She sought just $20,000 to cover her actual and anticipated expenses.  Instead, McDonalds offered a paltry $800!

When a tough defender of human rights was needed to help defend Stella Liebeck an Albuquerque personal injury lawyer was called in to help Mrs. Liebeck get a fair and equitable settlement.  That man was (and is) Kenneth Wagner.  Today Ken Wagner serves The Great Southwest from his office in ABQ.  Call the firm anytime at (505) 242-6300.

Big Rigs…Big Danger.

Let’s face it, they are a whole lot bigger than us.  Trucking accidents are serious business and we take each and every one of them very seriously.  How much do you think a typical tractor-trailer weighs?  The answer is about 80,000 pounds.  Now imagine that beast traveling at 65+ mph and the results can be catastrophic if you are clipped in your vehicle!

The Federal Motor Carrier Safety Administration says there are about 4,000 fatal crashes each year in the United States.  Many of those occur on the highways of The Great Southwest where truckers travel fast.  The blame for an accident is about 50/50 between motorists and truck drivers, but you know who comes out better in those confrontations!

One of the leading vehicle and truck accident attorneys in The Great Southwest is Albuquerque based.  We are The Ken Wagner Law Firm.  We are dedicated to protecting your rights when you are involved in a Big Rig accident.  Please do not hesitate.  Give us a call as soon as possible.  That’s The Ken Wagner Law Firm at (505) 242-6300.

Misunderstood Wrongful Death.

It is a nebulous concept for most of us.  Even if we are faced with a potential wrongful death case our grief is so palpable that even then the concept is almost undefinable.  IF a death is caused by a person or even a corporation that resulted from an intentional or reckless act, even if it is a relative who causes the event, it may be wrongful death.

Wrongful death cases are not limited to, but include –

1.  Murder
2.  A vehicle accident
3.  Medical malpractice
4.  Prescription drugs
5.  A dangerous product

Wrongful death attorneys are few and far between in the Great Southwest because it takes years of experience to properly try such a case.  There may be no one better at doing so than Ken Wagner of The Ken Wagner Law Firm located in Albuquerque, New Mexico.  If you feel that you may have a wrongful death case call The Ken Wagner Law Firm at (505) 242-6300.

What is the Difference Between Medical Malpractice and Medical Negligence?

Medical malpractice (or med mal as it is sometimes known) is a breach of duty by a physician or medical facility.  Medical negligence does not involve intent.  In the case of negligence, the provider has made a mistake and caused unintentional, but REAL harm to the patient with whom they were entrusted.

Here are things that must be shown to prove medical malpractice –

1.  There was a previous relationship between the doctor and the patient.
2.  The doctor’s negligence directly resulted in the injury.
3.  Specific damage was done.
4.  Improper treatment was administered.
5.  No previous warning was given to the patient.

Proving and winning a medical malpractice case is one of the most challenge things that a personal injury attorney firm can do.  The Ken Wagner Law Firm knows what it takes to prove a case in Albuquerque or anywhere in the Great Southwest.  Enter into the process with confidence.  Start by calling The Ken Wagner Law Firm at (505) 242-6300.

No One Understands Burn Accidents More than We Do.

There are more than a million burn injuries a year occurring in America.  One of them may have recently happened to you or loved one.  One of the great tragedies is that about half of all burn injuries happen to children under the age of four.  Those statistics are provided by the Alisa Ann Ruch Burn Foundation.

There are 1st degree burns that affect just the outer layer of your skin.  Then there are 2nd degree burns.  With these your skin will turn red and pain will be accompanied by blisters that contain a clear fluid.  Then there are the dreaded 3rd and even 4th degree burns.  These will often cause extensive scarring and may require multiple surgeries.

When you believe that you have a case because of a severe burn that you have received you turn to the man who helped win the famous McDonald’s Hot Coffee Case.  He is Ken Wagner of The Ken Wagner Law Firm.  For decades he has been known throughout the Great Southwest as Albuquerque’s premier burn injury attorney.  Call the office today at (505) 242-6300.

There are Still a Lot of Train Tracks Out There.

The Great Southwest is still dotted with tracks and high-speed trains.  The era of train travel is far from over in our wide-open spaces, especially as it pertains to the movement of goods.  When it is train vs. almost any other vehicle imaginable the choo-choo always wins!  Don’t try to outrun or outsmart one, they are on-track to destroy anything in front of them.

There are four major reasons for train accidents in the Great Southwest –

1.  The equipment that controls them
2.  The condition of the tracks that they run on
3.  Signals at crossings
4.  Human error

There are about 6000 train crashes per year in the United States resulting in nearly 3000 injuries or deaths.  If you or loved one has been the victim of a train accident in the Great Southwest call Albuquerque personal injury law firm Ken Wagner Law.  We have a team who will investigate and pursue the compensation that you deserve.  Call (505) 242-6300.

They May Have a License, but are They Professional?

If you or a loved one suffered in any way because a professional that you hired was negligent or careless in providing you with a service that was lower than the acceptable standard in the industry you may want to seek legal representation.  Maybe the “professional” claimed that they were offering their best effort, but you can see clearly that they were not.

Here are some people who could be guilty of professional negligence –

1.  Contractors…so many SEMI-competent folks out there
2.  Physicians…the consequences could be astronomical!
3.  Dentists…nothing to smile about
4.  Insurance adjusters…no surprise there
5.  Attorneys…yes, there are some nefarious ones out there

We are here to help you get restitution.  We are professional negligence attorneys Ken Wagner Law.  Serving The Great Southwest in personal injury claims for decades we have helped take on McDonald’s in the famous Hot Coffee Case and you know what happened.  If you don’t then look it up!  Call Ken Wagner Law today at (505) 242-6300.
