What Constitutes a Defective Product?

Throughout the USA defective products cause thousands of injuries every year. It runs the gamut from recalled vehicles due to defective airbags, etc. to recalled pieces of furniture due to toppling risks. Just too many products that contain hazardous defects are sold to the American public who put their trust in the manufacturer!

We have discovered that the three different types of product liability claims are –

  1. The defective design of the product.
  2. An improper warning claim. The manufacturer has a legal duty to warn the public.
  3. Here is the most common…the original design of the product is completely safe, but something happened during the manufacturing process to make the product unsafe.

A Defective Product lawsuit is one that should be trusted to those that have years of experience. Here at The Ken Wagner Law Firm we have dealt with defective product claims for decades in The Great Southwest. Speaking of warning labels, our founder was one of the lead attorneys in the McDonald’s Hot Coffee Case. Call The Ken Wagner Law Firm of Albuquerque if you or a loved one has been injured by a defective product at (505) 242-6300.

A second-degree burn affects the outer layer of skin medically known as the epidermis and part of the inner layer of skin. Here are some possibilities –

How Soon is Too Soon to Act.

With some things in life we are given time to carefully consider our options. The pandemic is perhaps one of those times. When you are involved in an auto accident the time to act is immediately! Intellectually you already know this, but sometimes the shock and awe of the situation may overwhelm you.

Here is what happens…more quickly than you can imagine, insurance companies send out investigators, accident reconstruction experts and other professionals to start to defend the case that they will prepare to bring against the driver they have insured. The insurance company will spend big bucks and plenty of time to properly present its case.

What have you done in the interim? If the answer is “contact an auto accident injury attorney”, then you have made the right call! If that accident happens anywhere in The Great Southwest the right call is probably made to The Ken Wagner Law Firm of Albuquerque. They bring a half-century of experience to bear.
