What is the 3rd Leading Cause of Death in the US?

Is it heart disease or cancer? No, it is medical malpractice. Did you know that? Almost a quarter-million people in America die of Med Mal every year! Such events like unnecessary surgery, infection contracted in the hospital, errors made in the doling out of medication, or even the adverse reaction to certain medications given.

Here are some other examples of medical malpractice –

1.  Mistakes made by the pharmacy

2.  Errors made in the course of a transplant

3.  Certain procedures while “under the knife”

4.  Injury or even death caused at birth

There are many and varied types of medical malpractice. In The Great Southwest, this challenging offense may be best litigated by the team at Ken Wagner Law. Ken is the legendary lead attorney working out of Albuquerque NM to handle different sorts of medical malpractice. Just google kenwagnerlaw.com. As soon as you can call (505) 242-6300.

The Cruelest Cut of All.

When an injury or death occurs to an unborn baby and/or the mother during labor in the delivery process, in many cases the harm may have been unavoidable under the circumstances.  In other situations, the course of treatment chosen by the doctor may have been inappropriate, or the physician may have failed to use proper skills and care before or during childbirth.

Certain events may occur such as caput succedaneum, which is the swelling of a newborn’s scalp, typically caused by pressures on the baby’s head during a difficult or prolonged head-first delivery.  Cephalohematoma is another type of birth injury that can be the result of vacuum extraction.  There are so many more things that can go horribly wrong.

If you have suffered from someone in your family being the victim of a birth injury or death it is important to call a qualified birth injury attorney in The Great Southwest.  You can rely on The Ken Wagner Law Firm of Albuquerque to investigate it thoroughly to see if you have a case.  Please call (505) 242-6300.

How Hard is it to Prove Medical Malpractice?

It all begins with one critical question…was the provider guilty of negligence?  Just because there was a bad, unexpected outcome does not mean that negligence occurred.  And even the fact that another health care provider would have acted differently does not mean there was negligence either.

The health care provider in question is deemed negligent only if he or she has acted unreasonably; done something no reasonable health care provider would have done under the circumstances.  Whether an act (or inaction) by a health care professional is reasonable can only be analyzed based on the specific circumstances of the case.

This is all very tricky and demands that a seasoned professional team with a renowned medical malpractice attorney at its helm handles your case.  In The Great Southwest that man and that team are Albuquerque’s Ken Wagner of The Ken Wagner Law Firm.  Find out if your case has merit.  Contact The Ken Wagner Law Firm at (505) 242-6300.

Medical Malpractice is Tough to Prove, but May be Worth it.

There may be no other branch of the law tougher to prove than what attorneys refer to as Med Mal.  You had better have the resources, talent, and deep pockets to pursue it to the finish line as a law firm.  Basically, no one sues for medical malpractice unless they KNOW that their injury was the fault of a medical provider.

You wouldn’t think it were possible, but doctors have admitted lying under oath to protect a fellow doctor during a medical malpractice trial.  With a straight face they will say to a jury that a fellow colleague’s care has NOT been substandard.  Hippocrates would roll over in his grave if he knew that his oath was taken so “fast and loose”!

Someone should be there to help.  In The Great Southwest WE are that someone.  We are Ken Wagner Law with headquarters in Albuquerque but serving all of the area known as the Great Southwest.  If you or a loved one has been harmed by someone you trusted to provide medical care, please call us immediately at (505) 242-6300.

Why a Medical Malpractice Case Demands the Best.

Proper representation in what attorneys know as “med mal” is so critical because the stakes are so high.  Not only that, but the other side has deep pockets as well as a reputation to protect.  A doctor or hospital will fight with all of its resources to prove its innocence.  You had better bring your “A” game to the table!

Doctors and hospitals make life-altering mistakes sometimes.  It is simply a fact!  When it happens to you or a loved one you need to seek fair compensation.  There are diagnosis failures, transplant mistakes, pharmacy mix-ups, injury or death when giving birth…and that is just the beginning.

Would you like to be represented by the firm whose founder helped successfully hold McDonalds accountable in the famous Hot Coffee Case?  I thought so!  That law firm is known throughout the Great Southwest as Ken Wagner Law.  You will be working with Ken and his team located in Albuquerque known for its aggressive prosecution of medical malpractice cases.  Give them a call today for a free consultation at (505) 242-6300.

Sloppy Medical Practices.

We have all heard about the really dumb stuff.  A surgeon operates on the wrong leg or leaves a something in the patient’s body.  These days, thank goodness, those incidents are becoming more rare.  Blunders still occur though.  For example, a surgeon may be operating on the wrong vertebra because of an unclear X-ray.

The bigger issue may be whether or not the treatment plan is even right in the first place.  There was actually a U.S. study that revealed nearly HALF of the patients surveyed did not receive the recommended care for their particular conditions!  Humans are not cranked out of some assembly line and one treatment does not necessarily fit all.

All of this is simply to say that you or a loved one may have been given shoddy medical treatment.  If that is the case, then you may have a case against a physician or medical center.  If you have received improper medical care in the Great Southwest please call (505) 242-6300.  The office of Ken Wagner headquartered in Albuquerque may be able to get you the compensation that you deserve!

There are Dangerous Doctors Out There!

Truly bad doctors, thank heaven, are few and far between.  Make no mistake about it however, they do exist in every city in the United States.  Recently one US state combed the entire database of doctors on probation.  The results were sobering.  They found several hundred doctors had been disciplined, but often NOT barred from practice.

Blatant negligence, practicing while under the influence of drugs and/or alcohol, even engaging in sexual misconduct with patients happens daily in this country.  Some doctors are just simply incompetent.  As skills diminish in older practitioners complications arise.  Patients are readmitted to the hospital for the same malady and some even die!

We want to help you, not scare you.  Please be aware that all medical treatment is not the same.  If you feel that a doctor has made things worse for you or a loved one, please contact Albuquerque medical malpractice attorney Ken Wagner.  Attorney Wagner and his staff have been helping people of the Great Southwest combat bad medical care for decades.  Call today at (505) 242-6300.

Are You Getting the Right Drug?

Among all preventative health care mistakes adverse reaction to an improperly prescribed drug is near or at the top.  Every time that you are prescribed a certain drug there are multiple steps along the way where errors can occur.  Ordering the right medication in the right amount for your body is not an exact science.  Even passing the proper information from doctor to pharmacist can go horribly wrong.

Did you know that drug missteps lead to nearly three-quarters of a million emergency room visits per year?  Well over 100,000 people a year are even hospitalized by the improper administration of a prescription drug!  A study was done last year that found nearly HALF of the drugs administered during or after surgery resulted in some snafu.

While most of these drug mishaps are preventable they still continue every day in this nation of advanced medicine.  When you feel that you or a loved one has been harmed by poor management of prescription drugs call Ken Wagner.  From his Albuquerque office he will put his 40 years and his team’s medical malpractice experience to work for you.  Anywhere in the great Southwest make the call to the Wagner Law Office today for a free consultation at (505) 242-6300.

Medical Malpractice and its Intricacies.

So many times people believe that they have a legitimate medical malpractice case - and they do.  What they may fail to recognize is that the “other side” has deep pockets and is heavily “lawyered up”.  Therefore, the journey to recover damages from a legitimate malpractice case tends to bog down because the plaintiff (YOU) does not have the right attorney to fight all the way to the finish line.

What are some examples of medical malpractice?  Here are some that may fit your situation –

1.  Prescription error.  Did you get the correct medication in the proper dose?
2.  Injury or even death at the hospital during a birth.
3.  Misdiagnosis.  It happens more than you can imagine.
4.  An infection in the hospital.  The medical centers of this country are not as clean as you think.
5.  Failure of a medical product.  You took it or used it in good faith with disastrous results.

If you or a loved one feel that you have a decent case call Ken Wagner.  He is the Great Southwest’s medical malpractice champion.  From his office located in Albuquerque he will put his 40 years and his great staff to work to win your case.  Call the Wagner Law Office today for a free consultation at (505) 242-6300.  Consult with the best, the winner of the McDonald’s Hot Coffee Case Ken Wagner.

What is Medical Malpractice?

To know if you have a good Med Mal case, as it is known in the industry, it is important to know what constitutes medical malpractice.  We often hear about it in the news and from others, but there are very specific guidelines that constitute a case.

In the state of New Mexico medical malpractice may include…

1.)           Misdiagnosis or a complete failure to diagnose a medical problem
2.)           Mistakes that occur in hospitals and especially during medical procedures
3.)           Injury or death during birth
4.)           Infections that come from the hospital environment
5.)           Cancer that is improperly diagnosed or missed altogether
6.)           Errors that occur at the hospital or any pharmacy
7.)           Any mistake in prescriptions
8.)           The failure of a medical product

You or someone that you love may have been a victim of medical malpractice in New Mexico.  It is important to start with a lawyer who has had decades of experience dealing with med mal cases in the state.  You will also need a health care provider who is willing to stand up in court and verify your claim.  When you contact Ken Wagner Law in Albuquerque you have the team that you need to aggressively pursue your case.  Call them today at (505) 242-6300.
